Justice Ayesha removed from constitutional bench hearing ICA on military trials ruling

Justice Ayesha A Malik has been removed from the seven-member constitutional bench that was set to hear the Intra Court Appeal (ICA) filed by the federal government. The appeal challenges the Supreme Court’s ruling that declared the trial of civilians in military courts unconstitutional.

The decision was made during the third meeting of a three-member committee, which took place on November 13. This committee was formed under Article 191A (4) of the Constitution and was chaired by Justice Aminuddin Khan. The meeting was also attended by Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, and the registrar.

The removal of Justice Ayesha A Malik from the bench has drawn attention, as she had initially been a part of the panel that was expected to review the government’s appeal against the Supreme Court’s verdict.
