Indian news agency takes legal action against OpenAI for unauthorized use of content in AI training

Indian news agency ANI has filed a lawsuit against OpenAI in a New Delhi court, accusing the creator of ChatGPT of using its published content without authorization to train the AI chatbot for user interactions.

ANI joins a growing list of global news organizations suing OpenAI, following similar actions in the United States by outlets such as the New York Times and Chicago Tribune.

The initial hearing of the case took place in New Delhi’s High Court on Tuesday, where the judge issued a notice to OpenAI, requesting a detailed response to ANI’s claims.

ANI has also alleged that OpenAI’s services falsely attributed fabricated news stories to the agency, according to a court filing from Monday, reviewed by Reuters.

In response to the lawsuit, OpenAI stated, “We build our AI models using publicly available data, in a manner protected by fair use and related principles, and in accordance with long-standing legal precedents.”

OpenAI, along with other tech companies, has faced a surge in lawsuits from authors, visual artists, music publishers, and other copyright holders for alleged unauthorized use of their works. OpenAI has denied any copyright infringement.

ANI’s filing claims that OpenAI “refused to obtain a lawful license or permission” for the use of its original content. It pointed out that OpenAI had entered into licensing agreements with news organizations like the Financial Times and the Associated Press for similar uses of copyrighted material.

OpenAI has stated it is in talks with numerous news organizations worldwide, including in India, to explore potential partnerships.

The next hearing for the case is scheduled for January 28.
