LHC Upholds Ruling: Non-Muslims Cannot Inherit Muslim Property
The Lahore High Court delivered an important judgment on Saturday regarding the inheritance rights of non-Muslims.
Justice Iqbal Chaudhry, who heard an appeal against a lower court’s decision, upheld the ruling that non-Muslims are not entitled to inherit property from a Muslim under Islamic law.
The High Court dismissed the appeal, reinforcing the lower court’s decision. The court stated that Islamic principles prevent non-Muslims from claiming inheritance rights to a Muslim’s property.
The case involved 83 kanals of land owned by a deceased Muslim from Gojra, which had been divided among his heirs. A grandson challenged the allocation, objecting to the distribution of a portion to his non-Muslim uncle.
The lower court sided with the grandson, citing the uncle’s non-Muslim status. The uncle appealed, but the Lahore High Court upheld the original ruling.
